FAQ

Know Your Rights

Let's shine a light on some answers that can help you identify
and protect yourself against debt collectors.

Q: What is considered illegal for debt collectors under the FDCPA?

+

Debt collectors often engage in behavior that is harmful to consumers. We are here to protect you from that.

  • High rates & fees
  • Unfair repayment terms
  • Pressure to borrow more
  • Deceptive tactics
  • Preying on vulnerable
  • Unlicensed lenders

Q: Do I need an attorney to deal with debt collectors?

+

Whether you need an attorney to protect you from debt collectors depends on your specific situation. While it's possible to handle debt collection issues on your own, having an attorney can provide numerous benefits.

Attorneys experienced in debt collection laws can offer legal expertise, negotiate with collectors on your behalf, ensure your rights are upheld, and potentially prevent aggressive or illegal collection tactics. If you're facing significant debt or encountering difficulties with collectors, consulting with an attorney can provide valuable guidance and support tailored to your circumstances.

Q: Can debt collectors call me at any time?

+

No. Federal law sets clear limits on debt collection calls so everyone benefits from fair treatment.

Debt collectors cannot contact you at inconvenient times, generally defined as before 8am or after 9pm and must respect your preferred method of communication.

Q: How can I verify a debt's validity?

+

Under the FDCPA, you have the right to request validation of the debt. Within five days of the initial contact, the debt collector must provide you with information regarding the debt, including the amount owed and the original creditor.

Q: Can debt collectors threaten legal action against me?

+

Debt collectors cannot make false threats of legal action or claim to have powers they do not possess. They must adhere to respectful practices when communicating with you.

Q: What benefits could I receive from suing a debt collector?

+

Our Attorneys work to negotiate tradeline deletion, debt waiver, and statutory damages plus attorneys fees when they pursue an action on your behalf against a debt collector who has violated the FDCPA.
